Terms of Service

By accessing or using the Aviator Connect platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the platform. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

These Terms apply to all users of the Service, including pilots, airlines, recruiters, and any other visitors or users.

To use our Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Service under applicable law
• For pilots: hold or be pursuing valid aviation credentials
• For airlines: be an authorized representative of the organization

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

You retain ownership of any content you submit to the platform ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the Service.

You represent and warrant that:

• You own or have the right to share your User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with all applicable laws and regulations
• Your User Content is accurate and not misleading

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate at our sole discretion.

7.1 Plans

Use of the Service is free of charge for pilots. For airlines, the Standby plan is free and requires no contract; all other plans are paid. By subscribing to a paid plan, you agree to pay all fees associated with it. Fees are stated exclusive of VAT and other applicable taxes.

7.2 Contract Term and Early Termination

Paid plans are concluded for a fixed term of 12 months. We do not offer monthly plans. You may terminate the contract in text form up to the end of day 30 following the start of the contract, without giving a reason. After that date the contract runs for the remainder of the term. Unless terminated with the notice period stated in your order form, the contract renews for a further 12 months.

7.3 Contact Credits

Paid plans include an allowance of contact credits. A credit is consumed when you contact a pilot through the Service; searching, filtering and saving searches do not consume credits. The allowance applies to the contract year as a whole rather than per month, and unused credits expire at the end of the term without carrying over.

While the early termination right under section 7.2 remains available, the credits accessible in that period are limited to the monthly reference rate of your plan. The full annual allowance becomes available once that period has ended.

If a contacted pilot does not respond within 14 days, the credit is returned to your allowance. We do not warrant that any pilot will respond to a contact request; whether to respond is the pilot's own decision.

7.4 Billing

Fees are invoiced in advance in accordance with the billing schedule set out in your order form. EUR is the list currency; prices in other currencies are maintained separately and are not derived from a daily exchange rate.

7.5 Price Changes

We reserve the right to modify pricing. Price changes will be communicated at least 30 days in advance and take effect no earlier than the start of the next contract term. Prices agreed for a running term remain unchanged for that term.

7.6 Refunds

Fees are non-refundable except as required by law. In particular, credits that have already been used are not refunded, and unused credits are not reimbursed when a contract ends. The early termination right under section 7.2 is the remedy available if the Service does not meet your expectations at the outset. Please contact our support team with any billing concern.

The Service and its original content (excluding User Content), features, and functionality are owned by Aviator Connect GmbH and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, logos, and trade names may not be used in connection with any product or service without our prior written consent.

Pilots, and airlines using the free Standby plan, may terminate their account at any time by contacting us or through their account settings. For paid airline plans, the fixed term and the early termination right set out in section 7.2 apply; closing the account does not end the contract or the obligation to pay the fees for the agreed term.

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate any provision of these Terms
• Engage in conduct harmful to other users or the Service
• Create legal liability for Aviator Connect
• Fail to pay applicable subscription fees

Upon termination, your right to use the Service will immediately cease. Certain provisions of these Terms will survive termination.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

For EU consumers: You may also be entitled to bring proceedings in your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
